B1 Business Visa

The general rule is that a foreign national, who wishes to come to the United States, must first obtain a visa. One of the routes in is a non-immigrant visitor visa. This is for those who wish to enter temporarily for things like Business (B-1), pleasure or medical treatment (B-2), or a combination of both.

The B-1 Visa is for business visitors who want to enter the United States for a temporary period. The visa allows for legitimate business activities, such as meetings, conferences, consultations and negotiating contracts. The visa doesn’t allow the entrant to work however, nor can they be paid from a U.S. source.

Who would need a B-1 Visa?

This type of visitor visa allows people to attend conferences, conventions, workshops or seminars. It doesn’t matter if these are scientific, educational, professional, business, or religious.

Personal and domestic assistants need a B-1 Visa, even when they are coming to the United States with a U.S. citizen. The government is extremely cautious with these entries due to human trafficking.
Professional athletes, who need to compete in a tournament that involves prize money and not a salary, also need to attain this visa.

Business Purposes

Individuals can work on specific projects in the United States, as long as they are being paid by a foreign employer. Research studies are also permitted under this visa, as is business research with regards the possibility of setting up a subsidiary of a corporation, or a franchise development. In conjunction with that research, observations – without hands-on activity – are also permitted.

In the event of a contract or sale being agreed between a U.S. business and a foreign company, the technical personnel required for installations or after-sales service are eligible for the visa.

If a business professional is part of a Board of Directors for a United States corporation then they also require the B-1 visa, and the same goes for purchasing agents of a foreign employer, who need to come to the United States to procure goods, components, or raw materials for use outside the U.S.
